This privacy policy (“Privacy Policy”) describes the types of personal information that Social Agent, Inc. (“Social Agent,” “we,” “our,” and/or “us”) collects, uses, and discloses from individuals (“you” or “your”) who use our website (including www.socialagentapp.com) and services that link to this Privacy Policy (our “Service”), including users looking for photography, videography, or other content creation and editing services (“Purchasers”) and independent content creators and editors who offer their services (“Agents”).  By using our Service, you agree to the collection, use, disclosure, and procedures described in this Privacy Policy.  Beyond the Privacy Policy, your use of our Service is also subject to our Terms of Service.

Personal Information We Collect

We may collect a variety of personal information from or about you or your devices from various sources, as described below.

A. Personal Information You Provide to Us

Registration and Profile Information. When you sign up for an account, we ask you for your name, email address, phone number, and confirmation that you are over the age of 18.  If you sign up using your Apple or Google account, we may also receive information from those social media services such as your name, email address, gender, date of birth, profile photo, and friends.  For Agents, we may also collect any information you provide in your application.

Communications. If you contact us directly, we may receive additional information about you, such as your name, email address, phone number, the contents of a message or attachments that you may send to us, and other information you choose to provide.  If you subscribe to our newsletter or opt-in to our promotional emails and offerings, then we will collect certain information from you, such as your email address.  When we send you emails, we may track whether you open them to learn how to deliver a better customer experience and improve our Service.

Careers. If you decide that you wish to apply for a job with us, you may submit your contact information and your resume online.  We will collect the information you choose to provide on your resume, such as your education, employment experience, and professional license number.  You may also apply through LinkedIn, Indeed, or other third-party services.  If you do so, we will collect the information you make available to us on LinkedIn, Indeed, or other third-party services.

Payment Information. If you make a purchase through our Service, your payment-related information, such as credit card or other financial information, is collected by our third-party payment processor on our behalf.

B. Personal Information We Collect When You Use Our Service

Location Information. When you use our Service, we may receive your location information (for example, your IP address may indicate your general geographic region).  We may collect precise location data from your mobile device when you order or accept a mission via the Social Agent app (i.e., the address of the location for the photography, videography, or other content production services).  We may also collect precise location data from your mobile device when the Social Agent app is running in the foreground (app open and on-screen) or background (app open but not on-screen).  We collect such data from the time the photography, videography, or other content production services are requested until such services are finished.

Device Information. We receive information about the device and software you use to access our Service, including IP address, web browser type, operating system version, phone carrier and manufacturer, application installations, device identifiers, mobile advertising identifiers, and push notification tokens.

User Content. We may receive any photos, videos, audio (including sound or voice recordings and musical recordings embedded in the video or audio), messages, reviews, images, data, and text you upload to the Service.  In addition, Agents may use third-party editing applications to edit your content.  Agents will upload the content they create from the third-party editing applications to the Social Agent app.  We will receive all content captured, created, and produced on your behalf as part of the Service.

Usage Information. To help us understand how you use our Service and to help us improve it, we automatically receive information about your interactions with our Service, such as the pages or other content you view, referrer information (the website you visited before coming to our Service), the dates and times of your visits,  purchases you make, your reviews of agents, your comments, and any content you post.

Messages Between Purchasers and Agents. When you communicate with other users through our Service, we and our third-party partners receive the content of the messages you send and receive and information about those messages, such as when it was sent or received.

Information from Cookies and Similar Technologies. We and our third-party partners collect information about your activities on our Service using cookies, pixel tags, SDKs, or other tracking technologies.  Our third-party partners, such as analytics, advertising, and security partners, may also use these technologies to collect information about your online activities over time and across different services.

C. Personal Information We Receive from Other Sources

Information from Third-party Services. If you choose to link our Service to a third-party account, we may receive information about you, including your profile information and your photo and your use of the third-party account.  If you wish to limit the information available to us, you should visit the privacy settings of your third-party accounts to learn about your options. 

Background Checks. We work with third-party partners to perform background checks on our Agents and receive publicly available information such as criminal history.

Identity Verification. We work with third-party partners to verify the identity of our Agents and may collect identity verification documents and photos such as driver’s licenses or passports and user-submitted photos such as selfies.

How We Use the Personal Information We Collect

We use the personal information we collect:

  • To provide, maintain, improve, and enhance our Service;
  • To personalize your experience on our Service, such as by providing tailored content and recommendations; 
  • To understand and analyze how you use our Service and develop new products, services, features, and functionality;
  • To communicate with you, provide you with updates and other information relating to our Service, provide information that you request, respond to comments and questions, and otherwise provide customer support;
  • To facilitate the connection of third-party services or applications, such as editing applications and social networks;
  • For marketing and advertising purposes, such as developing and providing promotional and advertising materials that may be relevant, valuable, or otherwise of interest to you;
  • To generate anonymized or aggregate data containing only de-identified, non-personal information that we may use for any lawful purposes;
  • To make calls to you and send you text messages and push notifications;
  • To facilitate transactions and payments;
  • To find and prevent fraud and abuse, and respond to trust and safety issues that may arise; 
  • For compliance purposes, including enforcing our Terms of Service or other legal rights, or as may be required by applicable laws and regulations or requested by any judicial process or governmental agency;
  • To monitor the quality of our Agents, including the comments and reviews that you may provide; and 
  • For other purposes for which we provide specific notice at the time the information is collected.

How We Disclose the Personal Information We Collect

Partners and Affiliates. We may disclose any information we receive to our current or future partners and affiliates for any of the purposes described in this Privacy Policy. 

Vendors and Service Providers. We may disclose any information we receive to vendors and service providers retained in connection with the operation of our Service, including third-party editing applications. 

User Content.  If a Purchaser creates a group with other Purchasers, your content will be shared with the other Purchasers.  We are not responsible for the other Purchasers’ use of available information, so you should carefully consider whether and what to share with other Purchasers or how you identify yourself on our Service.

Social Networks and Other Online Services. Our Service allows you to, upon your direction, disclose information to social networking services, such as  Facebook, TikTok, and Instagram.  You understand and agree that the use of your information by any social networking websites will be governed by the privacy policies of these third-party platforms and your settings on that platform.  We encourage you to review their privacy policies.

Analytics Partners. We use analytics services such as Google Analytics to collect and process certain analytics data.  These services may also collect information about your use of other websites, apps, and online resources.  You can learn more about Google’s practices by visiting https://www.google.com/policies/privacy/partners/.

As Required By Law and Similar Disclosures. We may access, preserve, and disclose your information if we believe doing so is required or appropriate to comply with law enforcement requests and legal process, such as a court order or subpoena, respond to your requests, or  protect your, our, or others’ rights, property, or safety.  

Merger, Sale, or Other Asset Transfers. We may transfer your information to service providers, advisors, potential transactional partners, or other third parties in connection with the consideration, negotiation, or completion of a corporate transaction in which we are acquired by or merged with another company or we sell, liquidate, or transfer all or a portion of our assets.  

Consent. We may also disclose your information with your permission.

Your Choices

Location Information. You can prevent your mobile device from sharing precise location information at any time through your device’s operating system settings.

Marketing Communications. You can unsubscribe from our promotional emails via the link provided in the emails.  Even if you opt out of receiving promotional messages from us, you will continue to receive administrative messages from us.  You can opt out from our promotional SMS text messages by replying “STOP” to our message.

Do Not Track. There is no accepted standard on how to respond to Do Not Track signals, and we do not respond to such signals. 

Third Parties

Our Service may contain links to other websites, products, or services that we do not own or operate.  We are not responsible for the privacy practices of these third parties.  Please be aware that this Privacy Policy does not apply to your activities on these third-party services or any information you disclose to these third parties.  We encourage you to read their privacy policies before providing any information to them.

Security 

We make reasonable efforts to protect your information by using security measures designed to safeguard the information we maintain.  However, because no electronic transmission or storage of information can be entirely secure, we can make no guarantees as to the security or privacy of your information.

International Visitors

Our Service is hosted in the United States (“U.S.”) and intended for visitors located within the U.S.  If you choose to use our Service from the European Union or other regions of the world with laws governing data collection and use that may differ from U.S. law, then please note that you are transferring your personal information outside of those regions to the U.S. for storage and processing.  We may also transfer your data from the U.S. to other countries or regions in connection with storage and processing of data, fulfilling your requests, and operating our Service.  By providing any information, including personal information, on or through our Service, you consent to such transfer, storage, and processing.

Update Your Information

You can update your account and profile information or close your account through your profile settings.

We will post any updates to this Privacy Policy on this page, and the revised version will be effective when it is posted.  If we make a material update, we may notify you of such update through our Service, by email, or other means.
